In l.28.3.2019 n.26 – reddito di cittadinanza – requisito di 10 anni di residenza – mancanza di una ragionevole correlazione – limitazione per gli stranieri – requisito del radicamento territoriale soddisfatto con 5 anni di residenza.
E’ costituzionalmente illegittimo l’art. 2, comma 1, lett. a) numero 2) d.l. 28.1.2019 n.4 conv. in l. 28.3.2019 n.26, nella parte in cui prevedeva che il beneficiario del reddito di cittadinanza dovesse essere residente in Italia per almeno 10 anni, anziché per almeno 5 anni. Il requisito decennale infatti non è ragionevolmente correlato alla funzionalità del Rdc ed appare artificialmente finalizzato al solo tentativo di limitare l’accesso agli stranieri; tuttavia, non costituendo il Rdc una prestazione assistenziale in senso stretto, nell’ottica di allontanarsi il meno possibile dal bilanciamento che, nella sua discrezionalità, è stato operato dal legislatore, la ragionevole correlazione tra l’esigenza del radicamento territoriale e la misura del Rdc appare ricomponibile individuando un termine di residenza di cinque anni.

It is constitutionally illegitimate Article 2, paragraph 1, letter a) number 2) d.l. 28.1.2019 n.4 conv. in l. 28.3.2019 n.26, in the part where it provided that the beneficiary of the citizenship income had to be resident in Italy for at least 10 years, instead of at least 5 years. In fact, the 10-year requirement is not reasonably related to the functionality of the Rdc and appears artificially aimed at the sole attempt to limit access to foreigners; however, since the Rdc is not a welfare benefit in the strict sense, with a view to departing as little as possible from the balance that, in its discretion, has been operated by the legislator, the reasonable correlation between the need for territorial rootedness and the measure of the Rdc appears recomposable by identifying a residence term of five years.
