Le direttive 93/109/CE e 94/80/CE, che stabiliscono le modalità di esercizio del diritto di voto e eleggibilità alle elezioni del parlamento europeo e alle elezioni comunali, devono essere interpretate in modo da evitare una limitazione della portata dei diritti e degli obblighi derivanti ai cittadini dell’Unione dall’art.22 TFUE e pertanto ostano alla normativa di uno Stato membro che introduca una discriminazione sulla base della cittadinanza vietando l’iscrizione ai partiti politici ai cittadini dell’Unione che risiedano nello Stato senza averne la cittadinanza.

Directives 93/109/EC and 94/80/EC, which establish detailed arrangements for the exercise of the right to vote and to stand as a candidate in elections to the European Parliament and in municipal elections, must be interpreted in such a way as to avoid restricting the scope of the rights and obligations incumbent on citizens of the Union under Article 22 TFEU and therefore preclude legislation of a Member State which introduces discrimination on grounds of nationality by prohibiting registration with political parties of citizens of the Union residing in the State without its nationality.
