Costituisce discriminazione il comportamento del Comune che ai fini dell’accesso dei cittadini extra UE a una prestazione di sicurezza sociale, indica come necessario un requisito non previsto dalle norme eurounitarie, violando l’obbligo di parità di trattamento previsto in sede UE e dissuadendo così gli interessati dalla presentazione della domanda nei termini stabiliti dalle norme interne; in tali casi l’interessato che è stato indotto a non presentare tempestivamente domanda ha diritto al risarcimento del danno patrimoniale da discriminazione in misura pari alla prestazione persa.

The practice of a municipality which, for the purposes of non-EU nationals’ access to a social security benefit, indicates as necessary a requirement which is not provided for by EU provisions, thereby breaching the principle of equal treatment and discouraging from applying within the time-limits provided by domestic legislation, amounts to discrimination. At such instances, those lead not to submit the relevant application are entitled to compensation for pecuniary damages caused by the discrimination in the amount of the value of the lost benefit.
