La disposizione del Regolamento della Regione Lombardia n. 4/2017 che, recependo l’art. 40, comma 6, TU Immigrazione, ammette all’accesso ai servizi abitativi pubblici, oltre ai titolari di permesso di lungo periodo, solo gli stranieri in possesso di permesso di soggiorno almeno biennale che esercitano una regolare attività di lavoro subordinato o di lavoro autonomo, deve essere disapplicata, unitamente alla predetta norma di legge nazionale, per contrasto con l’art. 12 della direttiva 2011/98/UE che, per quanto riguarda l’accesso all’alloggio, impone la parità di trattamento con i cittadini dello Stato ospitante in favore di tutti gli stranieri titolari di permesso unico lavoro: tale vincolo è derogabile da parte dello Stato membro, ma la deroga richiede una espressa manifestazione di volontà da parte dello Stato membro, che, in occasione del recepimento di detta direttiva, avvenuta con il d.lgs. 40/2014, non è stata formulata; conseguentemente è illegittimo, in quanto discriminatorio per ragioni di nazionalità, il provvedimento di cancellazione dalla graduatoria di una titolare di permesso unico lavoro motivata dall’assenza di occupazione al momento della domanda.

The provision of the Lombardy Region\'s Regulation no. 4/2017 which, transposing art. 40, paragraph 6, TU Immigrazione, admits to access to public housing services, in addition to holders of long-term permits, only foreigners in possession of a residence permit of at least two years who are regularly employed or self-employed, must be disapplied, together with the aforementioned provision of national law, for conflict with art. 12 of Directive 2011/98/EU, which, as regards access to housing, requires equal treatment with nationals of the host State in favour of all foreigners holding a single work permit: that constraint may be derogated from by the Member State, but the derogation requires an express manifestation of will on the part of the Member State, which, when transposing that directive, which took place by d. lgs. 40/2014, was not formulated; consequently, the measure removing a holder of a single work permit from the ranking list on the ground of the absence of employment at the time of the application is unlawful, as discriminatory on grounds of nationality.
